TRY A MATE

By clicking "ADD TO CART" you confirm that you read and acknowledge the following before you begin your test ride on a MATE Bike:

In exchange for providing you with the temporary use of a MATE bicycle for purposes of evaluating its operation and features, you agree to the following:

•You will inspect your MATE bike before you test ride it and will let MATE BIKE know if there appears to be anything wrong with the bike at any time during your use of the bike.

•You will follow the instructions of the member of MATE BIKE accompanying you on your test ride.The MATE is an electric-assist bike. It includes a battery, a motor, and a control system.

•You agree to become familiar with the operation of the electric-assist features of the MATE bike before you ride it.

•You will check your brakes and electronic controls and will not ride your MATE bike if the brakes are not working properly. You will be clear on the brakes configurations and function.

•You will observe all applicable laws, rules, and regulations when riding your MATE bike, including but not limited to those relating to helmets, signals, speed, and traffic.You will ride your MATE bike in a careful manner at all times.

•You will return the MATE bike in the same condition as before the test ride

You also agree to the following release of liability: I HEREBY ASSUME ALL OF THE RISKS OF OPERATING AND RIDING THE MATE BIKE, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of MATE BIKE, from dangerous or defective equipment or because of their possible liability without fault. I certify that I am physically fit, am an experienced bicycle rider, and have not been advised not to ride bicycles by a qualified medical professional. I certify that there are no health-related reasons or problems that preclude my operation or riding of the MATE bike.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by MATE BIKE as stated above, and that it will govern my actions and responsibilities while operating or riding my MATE bike. In consideration of permitting me to use, operate, and ride a MATE bike, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A)
I WAIVE, RELEASE, AND DISCHARGE MATE BIKE from any and all liability,
including but not limited to, liability arising from the negligence or
fault of MATE BIKE, for my death, disability, personal injury, property
damage, property theft, or actions of any kind which may hereafter occur to me including my use and operation of the MATE bike loaned to me;

(B)
I INDEMNIFY, HOLD HARMLESS, AND WILL NOT TO SUE MATE BIKE and waive them from any and all liabilities or claims made as a result of my use or operation of the MATE bike, whether caused by the negligence of MATE BIKE or otherwise. This includes participation of any hazardous activities. I indemnify MATE BIKE against any damage suffered by myself, my child/children and next of kin.

I acknowledge that riding a bicycle can be a dangerous activity, and may carry with it the potential for death, serious injury, and property
loss. The risks may include, but are not limited to, those caused by
terrain, facilities, temperature, weather, equipment, vehicular traffic, and actions of other people. This waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
